ORDER:
The Criminal Petition has been filed under Section 483(1) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to relax the conditions Nos.1 and 4 imposed against the petitioner/Accused No.1 vide order dated 20.05.2025 in Crl.M.P.No.292 of 2025 in Cr.No.77 of 2025 of Machavaram Police Station, passed by the learned XII Additional District and Sessions Judge, Vijayawada.
2. Heard Sri C.Nageswara Rao, learned Senior Counsel appearing for the petitioner and the learned Assistant Public Prosecutor. Perused the record.
3. The condition No.1 says that the petitioner shall appear before the SHO, Machavaram every Monday between 10.00 a.m. and 1.00 p.m. for a period of 6 months and the condition No.4 says that the petitioner is further
directed to surrender his passport to the police and not to leave the Country without prior permission of the Court.
4. The learned Senior Counsel submits that the daughter of the petitioner is pursuing her Master’s Degree in applied Computer Sciences in

Northwest Missouri State University and the petitioner and his wife need to attend his daughter’s commencement ceremony i.e., Graduation ceremony.
5. Pursuant to the directions given by this Court on 09.10.2025, the learned Assistant Public Prosecutor submits that the petitioner had co- operated with the Investigating Officer. Except filing of the charge sheet, material portion of the investigation is completed.
6. Considering the facts and circumstances of the case, the Criminal Petition is allowed relaxing the condition Nos.1 and 4 imposed against the petitioner/Accused No.1 vide order dated 20.05.2025 in Crl.M.P.No.292 of 2025 in Cr.No.77 of 2025 of Machavaram Police Station, passed by the learned XII Additional District and Sessions Judge, Vijayawada. However, the petitioner shall submit his itinerary to the Investigating Officer.
7. Accordingly, the Criminal Petition is allowed.
