1. By way of this petition the petitioner is praying for the following reliefs:
“10.1 That, this Hon’ble Court may kindly be pleased to issue a writ of mandamus directing the respondent authorities to take necessary action in the interest of justice for providing compensation or for grant of equivalent potential land under the provision of Right to Fair Compensation and
2 Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 and The C.G. Rehabilitation and Resettlement Policy 2007. 10.2 That, this Hon’ble Court may kindly be pleased to issue direction to the respondents to give compensation according to rule, within one month. 10.3 That, the Hon’ble Court may kindly be pleased to grant any other relief as it may deems fit and appropriate.”
2. Learned counsel for the petitioner submits that the petitioner is not challenging any
order of the respondents but filed the present petition for necessary direction to the respondent authorities to acquire their land and grant fair compensation or grant equivalent potential of land to the petitioner under the provision of Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 and the C.G. Rehabilitation and Resettlement Policy, 2007.
3. Learned counsel for the respondents submits that the authorities will decide the representation of the petitioner within 90 days.
4. Heard learned counsel for the respective parties and perused the record with utmost circumspection.
5. Considering the submission of the counsel for the petitioner and counsel for the respondents, this Court directs the petitioner to file fresh representation before the respondent no. 3 and 4 within 15 days from today and in turn the respondent no. 3 and 4 is directed to decide the representation of the petitioner in accordance with law within 90 days from the date of receipt of representation.
6. With the aforesaid direction, the present petition is disposed of. Sd/-
