As directed, learned State counsel has produced the case record of the court of Addl. Sub-Collector, Bhubaneswar, which reveals that the Petitioner was present at the time of hearing and had also filed hazira. The hazira itself is available in the case record. In such view of the matter, it cannot be said that the petitioner had no notice of the hearing of the case. 3. Be that as it may, since the Petitioner clams that the impugned order was passed without considering the materials on record including the fact that there was a valid lease, it is open to him to challenge such order by preferring revision under Section 32 of the OSS Act as the settlement operations are yet to be concluded. 4. The Writ Petition is therefore disposed of granting liberty to the Petitioner to prefer revision within fifteen days from today. If such Order No. 5. revision is preferred within the stipulated period, the same shall be considered in accordance with law. 5. Urgent certified copy of this order be granted on proper application.
