ORAL ORDER This writ petition is filed under Articles 226 & 227 of the Constitution of India, seeking a writ of mandamus directing the respondent No.3 to settle the retirement benefits of the petitioner, forthwith, without delay, along with interest.
2. The grievance of the petitioner is that, on 28.03.2022 the petitioner submitted a representation for voluntary retirement on medical grounds. The same has been accepted. Thereafter, the respondent No.3 has not paid the retirement benefits. Hence, he submitted a representation/legal notice dated 27.06.2023 vide

Annexure-D seeking payment of retiral benefits along with interest @ 24% p.a. The third respondent has considered the same and issued a communication dated 13.07.2023 vide Annexure-E, stating that in view of the pendency of W.P.No.61842/2016, the petitioner’s case is not considered, after disposal of the said writ petition, the same will be considered in accordance with law.
3. The learned AGA appears for respondent Nos. 1 and 2. None appears for respondent No.3.
4. The petitioner submitted a representation/legal notice dated 27.06.2023 vide Annexure-D to the third respondent. The third respondent has considered the same and issued a communication dated 13.07.2023 vide Annexure-E stating that, in view of the pendency of W.P.No.61842/2016, the petitioner’s case is not considered, after disposal of the said writ petition, the same will be considered in accordance with law. The said writ petition was disposed of on 07.02.2024.

5. In view of the above, this writ petition stands
disposed of, reserving liberty to the petitioner to file a fresh representation, enclosing all relevant documents, to respondent No.3. If such a representation is filed, the respondent No.3 is directed to consider the same as expeditiously as possible, not later than two months from the date of submission of the representation.
