These two criminal petitions are filed before this Court praying to quash the proceedings initiated against the petitioners in both the cases, who have been arraigned as accused Nos.1 to 3 and these two cases are registered against the respective petitioners in C.C.Nos.3090/2019 and 24156/2023. 3. The parties have filed joint memo and also joint application before this Court invoking Section 320 read with Section 482 Cr.P.C. praying this Court to quash the proceedings. In terms of the joint application, the respondent No.2 has agreed to withdraw the case in C.Misc.No.6/2019 which is pending for consideration for awarding maintenance and respondent No.2 has received Rs.5,00,000/- by way of Demand Draft bearing No.207389 from husband towards maintenance of children, permanent alimony and as full and final settlement. The respondent No.2 has no claim in future and she undertakes that she will not file civil or criminal or any maintenance case against the petitioners in future and also undertakes to withdraw C.Mis.No.6/2019. - 5 - NC: 2025:KHC:14709 CRL.P No. 10819 of 2024 C/W CRL.P No. 11377 of 2024 4. The respondent No.2 is present before the Court and has received Demand Draft for Rs.5,00,000/- and respondent No.2 has acknowledged receipt of the said amount and learned counsel for respondent No.2 has also identified respondent No.2 before the Court. In view of acknowledging receipt of amount of Rs.5,00,000/- in terms of Demand Draft and in view of joint memo filed by the parties, the joint memo is taken on record, the proceedings initiated against the petitioners herein in both the cases is hereby quashed and the respondent No.2 is directed to withdraw the case which is pending before the Trial Court within two weeks from today as undertaken in the joint memo.
