AUGUST 17, 2026 Heard. 2] The affidavit filed by respondent no.2 today is taken on record. 3] The contempt is alleged against respondent no.2. 4] We have gone through the order, of which contempt is alleged. Certain directions were given to respondent no.5 – Deputy Director of Education, Amravati Division, Amravati. Pending Contempt Petition, the order passed in Writ Petition was modified, and respondent no.2 was directed to take decision. Accordingly, respondent no.2 has taken decision in terms of the order, of which contempt is alleged. 5] The Counsel for the petitioners submits that the decision, so taken, is without application of mind. 2026:BHC-NAG:10593-DB
47-CP-121-2025 2 6] This argument, according to us, is not available to allege contempt. The direction is to take decision in the manner ordered vide order dated 3/12/2024 in Writ Petition No. 3891/2023. The decision has been taken. It’s a different matter that the decision is rendered against the petitioner, for which the petitioner may avail remedy as is available in law. 7] What is important in the present matter is that respondent no.2 has complied the order, though belatedly. 8] The contempt is, accordingly, purged. The petition is disposed of with liberty to the petitioner to avail remedy against the order passed by respondent no.2.
