A perusal of the judgment passed by learned Special Judge, Kangra at Dharamshala (learned Trial Court) shows that the learned Trial Court acquitted the respondent/accused on the ground that the witnesses had made improvements, there were discrepancies in the plcaes where the reoveries were e昀昀ected and memos were prepared and there was enmity between the parties. Prima facie, the improvements were not got proved from the Investigating O昀케cer, defective investigation will not bene昀椀t the accused and enmity is a double edged weapon while it furnishes the motive for false implication, it also furnishes the motive for commission of crime, therefore, there are arguable points involved in the present appeal. Hence, leave to appeal is granted. Application stands disposed of.
