The petitioner has filed the present writ petition claiming the following relief(s):- “10.1 This Hon’ble Court may kindly be pleased to direct the respondent No.2 i.e. Director General of Police Raipur (C.G.) to recall order dated 14/07/2023 and removed the penalty imposed upon the petitioner within stipulated of time in accordance with law. 10.2 That, this Hon’ble High Court pleased to direct the respondent no. 2, i.e. Director General of Police C.G. to consider the case Digitally signed by MOHAMMAD AADIL KHAN 2 of the petitioner as per rule in favour of petitioner and keen decided the appeal filed by the petitioner (Annexure P/4). 10.3 Any other order or orders, writ or writs, direction or directions as this Hon’ble Court may deem fit in the facts and circumstances of the case in favor of the petitioner, in the interest of justice.” 2. Learned counsel for the petitioner restricted his submission that against the order dated 14-07-2023 the petitioner has preferred a departmental appeal before respondent No.2 on 07-08-2023, but till date his appeal has not been decided and no orders have been passed, therefore, the respondent No.2 may be directed to consider the appel of the petitioner within a stipulated time frame. 3. Learned counsel appearing for the State has no objection if such a direction is made to the authorities and she would submit that the authorities will decide the pending appeal of the petitioner in accordance with law. 4. I have heard learned counsel for the parties and perused the material annexed with the petition. 5. Considering the submissions made by learned counsel for the parties, considering that the departmental appeal is pending since 07-08-2023 before respondent No.2, respondent No.2 is directed to decide the departmental appeal of the petitioner which is pending since 07-08-2023 within two months from the date of receipt of copy of this order in accordance with law on its own merits after giving proper opportunity of hearing to the petitioner. 6. The petitioner is directed to produce a copy of this order before respondent No.2 within a week from today. 7. The writ petition is disposed of with the aforesaid observation and directions.
