By this petition, the petitioner seeks the following reliefs: “10.1 That this Hon’ble Court may kindly be pleased to allow this petition and Directed to Res. Learned counsel appearing for the petitioner submits that the petitioner has prayed that his application for grant of voluntary retirement from service be considered and he may be given all the retiral benefits, upon which learned counsel appearing for respondent No.1/State and learned counsel appearing for respondents No.2 and 3 submit that the petitioner has made a long unauthorised absence from service and as such a departmental inquiry has been initiated against him in which he is not co-operating and he is not joining the departmental inquiry without any plausible reason though notices have been issued to him. The petitioner has failed to join the departmental inquiry, as such the departmental inquiry could not be concluded. 3. Be that as it may, the petitioner is directed to join the departmental inquiry. At this stage, learned counsel for respondents No.2 and 3 submits that since the presenting officer and the inquiry office have been transferred, therefore, no further date of departmental inquiry is fixed as on today. Hence, as soon as further date of departmental inquiry is fixed, respondents No.2 and 3 shall inform the said date to the petitioner vide a fresh registered notice directing him to join the departmental inquiry. In turn, respondents No.2 and 3 are directed to conclude the departmental inquiry within a period of two months from the date of receipt of the aforesaid fresh registered notice to the petitioner. 4. It is made clear that if the petitioner does not join the departmental inquiry, the respondents shall be at liberty to pass appropriate orders. 5.
