CM(M) 215/2025
1. The petition challenges the order dated 22.08.2024 by which the learned Trial Court rejected the suit of the petitioner under Order VII Rule 11 CPC.
2. The petitioner filed a suit claiming 1.75 crores for defamation and loss of reputation. This is a digitally signed order. 3. The perusal of the Trial Court record reveals that petitioner did not file the required court fee and despite grant of sufficient opportunities he did not make good the court fee and left with no option, the Trial Court rejected the plaint of the petitioner.
4. The learned counsel for the petition submits that petitioner is a poor person and, therefore, was not in a position to pay the requisite court fee.
5. Admittedly, suit has not been filed by petitioner as an indigent person and requisite court fee has not been filed with plaint.
6. Trial Court has granted sufficient opportunities to the petitioner to file the requisite court fee but petitioner did not comply with such directions.
7. Even now, when asked, the learned counsel for the petitioner states that petitioner is a poor person and does not ask for extension of time to file court fee.
8. There is no illegality or perversity in the impugned order passed by the Trial Court.
9. The impugned order, therefore, calls for no interference.
10. The petition is accordingly dismissed.
