The petitioners/accused Nos.5 and 6 are before this Court calling in question the proceedings in C.C.No.78/2021 registered for the offences punishable under Sections 323, 447, 427, 504, 506, 354, 109, 149 of the IPC.
2. Heard Sri Srinivas B. Naik, learned counsel for petitioners and Sri Sharad V. Magadum, learned AGa for respondent No.1 and Smt. Shriya S. Katagimath, lerned counsel for respondent No.2.

Facts in brief, germane as follows: The petitioners/accused Nos.5 and 6 along with others are alleged to have indulged in certain acts of

assault and also the ingredients of Section 354 of the IPC on 12.11.2020. This results in the complainant registering the crime on 17.11.2020 against all the accused. The petitioners were before this Court, at the stage of registration of the crime and during the pendency of the petition, charge sheet was filed against the petitioners. Therefore, the petition was withdrawn and the withdrawal of it has resulted in the present petition.

learned counsel appearing for the petitioners would contend that insofar as accused Nos.5 and 6 are concerned, there are no ingredients of any of the offences that are alleged. The learned counsel would further submit that the petitioner/accused No.5 is in possession of the property. If the accused No.5 is in possession of the property, he cannot be alleged of an offence under Section 447 of the IPC criminal trespass into his own property. Therefore, would submit that the proceedings be quashed against accused Nos.5 and 6.

5. Per contra, the learner AGA would refute the
submissions in contending that the police, after investigation, have filed a charge sheet. The charge sheet clearly narrates the role of these petitioners to be instigating the crime committed by accused Nos.1 to 4. Therefore, the petitioners should come out clean in a full blown trial. He would seek dismissal of the petition.
6. I have given my anxious consideration to the
submissions of the learned counsel for the parties and perused the material on record. 7. The aforenarrated facts are not in dispute. The incident that happens on 12.11.2020, triggers registration of the crime. The role of the petitioners are found in the following lines :

8. The allegation was that the petitioners have instigated the offence. The police after investigation, file a charge sheet. The summary of the charge sheet as obtaining in Column No.17 reads as follows:

A perusal at the summary of the charge sheet would clearly indicate that the allegations against these petitioners/accused Nos.5 and 6 are that they have instigated accused Nos.1 to 4, to commit assault or indulge in ingredients of the other offences. Barring this, there is no allegation against these petitioners. 10. As observed hereinabove, the counsel appearing for the petitioners submits the accused No.5 is in possession of the property. If accused No.5 is in possession of the property, it is understandable as to how Sections 427 or 447 can be laid against accused No.5, as there cannot be criminal trespass into ones own property. Therefore, in the aforesaid light, if further proceedings are permitted to continue against these petitioners, it would

become an abuse of the process of the law and result in miscarriage of justice. 11. For the aforesaid reasons, the following :
ORDER (i) The petition is allowed. (ii) The proceedings in C.C.No.78/2021 on the file of Additional Senior Civil Judge and JMFC, Hosapete, qua the petitioners/accused Nos.5 and 6, stand quashed. (iii) It is made clear that the observations made in the course of the order would not become applicable to the proceedings pending against any other accused before any Court of law.
