AMARDEEP CHOUBEY Digitally signed by AMARDEEP CHOUBEY Date: 2025.02.03 17:33:10 +0530 2 For Petitioner : Mr. Sandeep Jha, Advocate with Ms. Gunjan Tiwari, Advocate. For Respondents/State : Mr. Shreyansh Mehta, Panel Lawyer. For Respondent No.2 : Mr. Alok Bakshi, Advocate with Ms. Kusum Lalchandani, Advocate. For Respondent Nos.4 & 5 : Mr. Somnath Verma, Advocate Hon'ble Justice Shri Bibhu Datta Guru Order on Board 31/1/2025 1. By the present writ petition, the petitioner is seeking directions towards the respondents for necessary correction in her name and also want correction in her father’s and mother’s name in the mark-sheet and certificate of Class-10th. 2. Learned counsel for the petitioner would submit that the petitioner completed her schooling from Class 1st to 10th in the respondents Nos.4 & 5 schools and different classes of mark-sheets and certificates provided to her after passing the annual examination conducted by the School and Board. At the time of admission of the petitioner in Class 1st , in place of ‘Sonkar’ ‘Sunkar’ has been recorded in the admission register, which was repeated in Class 5th mark-sheet also. The petitioner, thereafter, got admission in Class 6th & 8th , where the name of her mother has wrongly been mentioned as ‘Gayatri Sonkar’ instead of ‘Gyante Sonkar’ even her father’s name has also wrongly been mentioned as ‘Suraj Sonkar’ instead of ‘Surat Sonkar’. The said mistake occurred in the mark-sheet of Class 10th . The petitioner completed her Class 3 12th, and the Board of Secondary Education has issued mark- sheet/certificate, in which, the name of her mother and father has been mentioned rightly i.e. ‘Gyante Sonkar’ and ‘Surat Sonkar’. As in the Class 10th mark-sheet of the petitioner, mother’s and father’s name has been wrongly mentioned, the petitioner submitted representations to the District Education Officer (DEO)/respondent No.3 on 03/08/2023 and also to the Board of Secondary Education, but in spite of submission of the representations by the petitioner, neither the District Education Officer nor the C.G. Board of Secondary Education has take any steps for correction of the names of her mother and father. 3. Learned counsel for the Chhattisgarh Board of Secondary Education/respondent submits that as per the circular of the Board dated 31/03/2022, for correction of name in the mark-sheet of Class 10th, the mark-sheet of Class 5th, Class 8th as well as the certified admission register of the school is necessary, hence, if the District Education Officer/respondent No.3 will certify the admission register, then the Class 10th mark-sheet/certificate can be corrected in accordance with the circular dated 31/03/2022. 4. I have heard and perused the record placed along with the writ petition as well as the reply filed by the respondents. 4 5. It appears from the pleadings of the petitioner that in the admission register, the title of the petitioner has been mentioned as ‘Sunkar’ in place of ‘Sonkar’ and the same is repeated in the Class 5th mark-sheet also. In the Class 10th mark-sheet of the petitioner, the mother’s and father’s name has also been recorded wrongly, whereas in Class 12th mark-sheet issued by the Chhattisgarh Board of Secondary Education, father’s and mother’s names of the petitioner recorded rightly i.e. ‘Surat Sonkar’ and ‘Gyante Sonkar’ respectively. It appears from the pleadings and contentions of the petitioner that the wrong entry occurred in the admission register is a bona fide mistake and as in the Class 12th certificate, which was issued by the Chhattisgarh Board of Secondary Education, the name of the petitioner, her mother’s and father’s name has rightly been recorded, hence, the petitioner is directed to approach the District Education Officer/respondent No.3 and the District Education Officer is directed to provide a certified copy of the corrected admission register of Class 1st , thereafter, the petitioner may approach the Chhattisgarh Board of Secondary Education by filing a fresh representation in accordance with the Circular dated 31/03/2022. In the event of filing of such representation, the Chhattisgarh Board of Secondary Education is directed to make necessary correction in the mark-sheet of Class 10th within a period of 30 days, as the Chhattisgarh Board of Secondary Education has 5 already provided a mark-sheet of Class 12th to the petitioner where the name of petitioner, name of her mother & father has been recorded rightly. 6. With the aforesaid observation and direction, the present writ petition is disposed of. SD/- (Bibhu Datta Guru) Judge Amardeep
