P.P. ------ 2/10.10.2025 Heard learned counsel appearing on behalf of Petitioner and learned counsel appearing on behalf of the State. 2. The petitioner is apprehending his arrest in connection with Bariyatu P.S. Case No. 10/2025, registered under sections 111(4) of BNS, 2023 and sections 15(c), 17(c),18(b), 22, 25, 29 of NDPS Act, pending in the Court of learned Special Judge, NDPS, Laterhar. 3. Learned counsel for the petitioner submits that false allegation is made of cultivation of poppy plants in the forest area though the petitioner has nothing to do with the said land and cultivation of poppy plants. He submits that two co-accused have been granted anticipatory bail in A.B.A. No. 4428 of 2025 and in A.B.A. No.4862 of 2025 and petitioner has no criminal antecedent which is disclosed in para 6 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that allegation of cultivation of poppy plant is there. 5. In view of the above and considering that petitioner has no criminal antecedent which is disclosed in para 6 of the petition and 2025:JHHC:31351 2 two co-accused have been granted anticipatory bail in aforesaid ABAs and even the land is of the Forest Department, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty-five thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge, NDPS, Latehar, in connection with Bariyatu P.S. Case No. 10/2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023. 7. This Anticipatory Bail Application is accordingly allowed and disposed of.
