Heard the parties.
The petitioner has been made accused in connection with Ketar P.S. Case No. 40 of 2025, for the offence registered under Section 64(1) of B.N.S., 2023, pending in the court of Sri Kamlesh Behra, learned Judicial Magistrate, 1st class, Nagar Untari, Garhwa.
On 19.5.2025, petitioner is alleged to have raped the victim.
Statement of the victim has been recorded during trial, in which, she has stated that the petitioner had only assaulted her, due to which, she has instituted this case.
It was submitted that petitioner had not sexually assaulted her.
In view of the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Kamlesh Behra, learned Judicial Magistrate, 1st class, Nagar Untari, Garhwa, or his successor, in connection with Ketar P.S. Case No. 40 of 2025.
