For Respondents No. 6 to 13 : Mr. Hemant Gupta, Adv. 3 Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 18-07-2025 1) By way of this petition, petitioners have sought following reliefs:- (i) Issue a writ a mandamus directing the respondent authorities to conduct an enquiry into the socio economic boycott of the petitioners and their families; (ii) Issue a writ a mandamus directing the respondent authorities to take appropriate measures and ensure a complete end of the socio economic boycott faced by the petitioners and their families. (iii) Issue a writ a mandamus directing the respondent authorities to initiate criminal proceedings for the socio economic boycott committed against the petitioners; (iv) Issue a writ a mandamus directing the respondents to pay compensation to the tune of Rs. 1,00,000/- per person to the petitioner and their family members. (v) Pass any other order the Hon'ble Court may deem fit in the interest of justice. 2) Learned counsel for the petitioners submits that petitioners who are residents of Village Dhaurabhata, Tahsil–Palari, District– Baloda Bazar-Bhatapara have been subjected to social boycott by the respondents No. 6 to 13. She further submits that respondent authorities have failed to take measures to safeguard petitioners and their family. She contends that a direction may be issued to the respondent authorities to initiate criminal proceeding against respondents No. 6 to 13 and make payment of compensation of Rs. 1 Lakh Rupees to the petitioners. 3) On the other hand, Mr. Gupta, counsel appearing for respondents
4 No. 6 to 13 submits that a criminal case for commission of offence punishable U/s 447, 379 r/w 34 of IPC has been registered against private-respondents and they are facing trial. 4) Learned State counsel submits that FIR was registered against private-respondents on 06.11.2020 for commission of offence punishable U/s 447, 379 r/w 34 of IPC and charge-sheet has been filed. 5) Heard. 6) Taking into consideration the fact that police authorities have already taken cognizance and registered FIR against private- respondents, relief No. 10.3 is redressed. With regard to relief regarding payment of compensation, petitioners would be at liberty to avail the civil remedy. 7) Accordingly, instant writ petition stands disposed of at admission stage itself.
