Complainant Gopchand Tandon is present before this Court. 2. Appellants are also present before this Court along with their Advocate. 3. An application has been filed under Section 320 (5) of Criminal Procedure Code for permission to leave to compound the offence under Section 420 of the IPC against the appellants on the basis of the complaint mad, by the complainant during pendency of the 2 appeal and it has been informed by the complainant Gopchand Tandon that the other complainant is suffering from cancer and he is in pitiable condition, therefore, he could not attend the Court. The application is supported by an afÏdavit also which is taken on record. Aadhar Card of the complainant Gopchand Tandon is also submitted by him. The compromise application is supported by the statement of the complainant Gopchand and Sukhchand also. 4. Since it is an compoundable offence with consent of the parties and leave of the Court and the compromise has already been arrived at between the parties, the order dated 1-10-2015 (Annexure A/1) passed by the learned Special Judge (Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Durg in Special Case No. 13 of 2005 whereby the appellants have been convicted under Section 420/34 of IPC and sentenced to undergo RI for three years and to pay fine of Rs.20,000/- with default stipulation, is set aside and the appellants are acquitted of the charge under Section 420/34 of IPC. 5. The appellants are reported to be on bail and their bail bonds shall stand discharged within a period of six months in view of Section 437-A of the Cr.P.C., to which State counsel has no objection. 6. Accordingly, Criminal Appeal No. 1280 of 2015 is disposed of in view of the aforesaid compromise arrived at between the parties.
