24.07.2025 1 Heard Mr. Shailendra Dubey, learned counsel for the respondent / Contemnor. The Contemnor is present in the Court in compliance of the Court’s order dated 10.07.2025. 2 The present contempt reference has been registered on the basis of an observation made by a learned Single Judge of this High Court in WP(227) No. 998/2024 (Shyamal Mallick Vs. order dated 18.07.2025, the matter was placed before the learned Single Judge in MCC No. 731 of 2025, in the following order has been passed by the learned Single Judge :-
“1) This MCC has been placed before this Court pursuant to direction issued by the Hon’ble Division Bench in CONTR No. 04 of 2025. 2) The contemnor appeared in person and by way of an affidavit has tendered his unconditional and unqualified apology with regard to the incident which took place on 3 rd July, 2025. He has also given his undertaking to uphold the majesty and dignity of the High Court. 3) Orally, the contemnor has tendered an apology and displayed real sense of remorse acknowledging the mistake on his part. The unconditional and unqualified apology tendered by the contemnor appears to be bona- fide. 4) When someone inflicts deep hurt, it is normal to experience intense emotions like anger, resentment, and grief, which can make forgiveness challenging. Forgiveness is a journey, not a one-time event. It does not mean excusing or justifying the wrongdoing or erasing the memory of what happened. Instead, forgiveness is about releasing the emotional burden and moving forward. Forgiveness requires confronting painful memories and difficult emotions, but it is also a sign of inner strength and a generous heart. By letting go of grudges, you're not ignoring the hurt, but rather choosing to release its hold on you. Forgiveness demands courage to let go of negativity and step forward into healing
3 5) Given the contemnor's prompt, unconditional, and unqualified apology, coupled with a commitment to refrain from repeating the act, I accept his apology. 6) Accordingly, this MCC stands disposed of. A copy of this order may be placed before the Hon’ble Division Bench in CONTR No. 04 of 2025.” 4 Mr. Dudey, learned counsel appearing for the respondent/Contenmor and the Contemnor, who is present in the Court, have given assurance that no such conduct would be reflected in near future. 5 In view of the assurance given by Contenmor as well as his counsel, the present proceeding is hereby dropped and notice issued to the Contenmor is discharged.
