By way of this petition, the petitioner has prayed for the following reliefs:- “10.1 That, this Hon’ble Court may kindly be pleased to issue direct the Respondent No. 5 to conclude the proceeding in Revenue Case No. 202411280600011/A- 68/2023-24 in accordance with law within the stipulated time framed by this Hon’ble Court. 10.2 That, this Hon’ble Court may kindly be pleased to issue appropriate writ/s, directions, orders directing the respondent no. 5 not to take any action against the petitioner before deciding the Revenue Case No. 202411280600011/A-68/2023-24 which is pending against the respondent no. 6 to 59 for the encroached land. 10.3 Any other relief, which this Hon’ble Court deems fit and proper, may also kindly be granted to the petitioner, in the interest of justice. 10.4 Cost of the petition may kindly be awarded to the petitioners.” 2. Learned counsel for the petitioner submits that respondent no. 6 to 59 are the persons who have done the encroachment over the government land and the revenue proceeding was initiated against the respondent no. 6 to 59 but the same has not been concluded till date. He further submits that the action of the respondent no. 1 to 5 and the orders dated 09.06.2025 and 13.06.2025 passed by Respondent no. 5 is arbitrary, illegal and 6 contrary to the law applicable to the facts and circumstances of the present case. 3. Learned State counsel submits that the petitioners themselves have admitted that they are encroachers upon a government land, therefore, on this ground alone, this writ petition deserves to be dismissed. 4. I have heard learned counsel for the respective parties and perused the record with utmost circumspection. 5. Perusal of record shows that respondent no. 6 to 59 are the encroachers upon the government land. In view of the order passed by this Court in WPC No. 2268 of 2014, the respondent no. 1 to 5 started the proceedings for removal of encroachment from the encroached land. The respondent no. 1 to 5 have drawn encroachment removal proceedings against 80 encroachers after affording them with an opportunity of hearing and verifying documentary records of their case. The grievance of the petitioners are that they are not being providing opportunity of hearing. 6. Therefore, the respondent no. 1 to 5 are directed that after giving due opportunity of hearing to the petitioners, they may pass an order with regard to encroachment removal proceedings. 7.
