Sharma, learned Additional Advocate General, appears and waives service of notice on behalf of the respondents. 2. With the consent of learned counsel for the parties, the matter is heard at this stage. 3. Petitioners are husband and wife serving as Junior Basic Trained (JBT) Teacher in District Chamba. They have preferred this writ petition seeking directions to respondents to consider and decide the representation preferred by petitioner No.1(wife) dated 03.10.2025 1 Whether reporters of print and electronic media may be allowed to see the order? Yes. 2 (Annexure P-3) for her transfer at or near her spouse (petitioner No.2) place of posting. Petitioner No.1 is serving at Government Primary School (GPS) Malla, Education Block, Chamba-I, District Chamba, H.P. w.e.f. 27.09.2022 whereas her husband is stated to be serving at GPS, Miyarigala, Education Block, Hardaspura, District Chamba, H.P where he was posted on 30.3.2024. Petitioner No.1 invoking clause 5.4 of Himchal Pradesh Transfer Policy, 2013 that provides concession to couple serving under State government seeks her posting at or around the place where her husband is serving. In this regard, she preferred the representation on 03.10.2025 (Annexure P-3). Her grievance is that the aforesaid representation has not been considered and decided till date. It appears that petitioner No.1 has completed normal tenure at present place of posting and thus is liable to be transferred. Learned counsel for the petitioners submits that petitioners would be satisfied in case the respondents are directed to consider and decide the aforesaid representation within a fixed time schedule. Learned Additional Advocate General is not averse to this prayer. 3

Looking to the limited grievance of the petitioners, this writ petition is disposed of by directing respondent No.2/competent authority to consider and decide the aforesaid representation of the petitioners (Annexure P-3) in accordance with law and applicable transfer policy also keeping in view the above observations, within a period of four weeks from today.
The decision so arrived at shall also be communicated to the petitioners. The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any. Jyotsna Rewal Dua November 18, 2025 Judge yogesh
