Order on Board
09.07.
2025
1. This is an office reference.
2. This Court, vide order dated 02.01.2025, passed in MCRC No. 8987 of 2024, while allowing the bail to the applicants, namely, Bhuneshwar Sahu and Manohar Lal Sahu, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 date of receipt of a certified copy of this order, if there was no legal impediment.
3. The learned Judicial Magistrate First Class, Raipur, District-Raipur (C.G.) vide his request letter dated 30.06.2025 has requested for grant of some more time for concluding the trial.
4. It transpires from perusal of the PUD that in the present case, there are total 12 prosecution witnesses, out of which the statements of 4 witnesses have been recorded. The evidence of remaining witnesses are yet to be recorded. Summons are being issued to the witnesses on a continuous basis. Since the accused persons are charged under Section 420 read with Section 34 of the Indian Penal Code, the defence takes considerable time for cross-examination of the witnesses. Furthermore, the advocate for the accused, namely Shri O.P. Sahu, come from Bilaspur, due to which day-to-day hearing of the case is not possible. Therefore, he prays for grant of further more time for concluding the same.
5. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of four months from today.
6. Accordingly, this CRMP stands disposed off with the aforesaid direction.
7. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
