Jaipur Gramin Present Tenant Flat No. B-24, Shiv Residence, Magalam City, Police Thana Kalwad, District Jaipur, Raj. (Accused In Present Confined In Jail Jaipur). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Kailash Chander Sharma For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 12/02/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 441/2024 registered at Police Station Kalwad, District Jaipur (West) for the offence(s) under Sections 127(2), 140(3), 308 (2) and 61(2)(a) of BNS. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. The accused petitioner is in custody since long and charge-sheet has already been produced. In the charge sheet role of the petitioner is specifically assigned. The offences alleged to have been committed by the petitioner are exclusively triable by Magistrate. [2025:RJ-JP:6137] (2 of 2) [CRLMB-15085/2024] The trial of the case will take considerable time. Therefore, the benefit of bail may be granted to the accused-petitioner. Per contra, learned Public Prosecutor opposes the bail application and submitted the factual report. Considering the fact that it is alleged against the petitioner that he alongwith the other co-accused after kidnapping the complainant Sahil Bharti and Sumit kept them in wrongful confinement and also gave them beating and thereafter, demanded ransom of Rs. 10,00,000/- (Ten Lakh). The petitioner was identified by the witness Sumit Kumar during the course of the investigation. Investigation also reveals that amount of Rs. 10,00,000/- (Ten Lakh) was transferred from the account of Sumit’s brother Amit to the account of other co-accused. In the investigation witness Sumit and Complainant Sahil Bharti in their statement rendered under Section 180 of BNSS have clearly stated that they were kept in captivation and thereafter present petitioner and other co-accused gave them beating and demanded ransom. Therefore, considering the above facts, this court is not inclined to grant the bail to the accused-petitioner. Accordingly, the instant bail application is hereby dismissed.
