HON'BLE MR. JUSTICE AVNEESH JHINGAN Order 20/01/2025
1.
The grievance raised in the present petition is that an appeal along with the stay application was filed before the Rajasthan Board of Revenue (for short ‘the Board’), Ajmer on 21.08.2024. On 29.08.2024 learned counsel Mr.Pushpendra S. Naruka appeared on caveat on behalf of the respondent. The appeal along with the stay application was heard but the stay application was
[2025:RJ-JP:2615] (3 of 3) [CW-19343/2024] not decided. The respondents alienated the part of land-in- question in the meanwhile. The prayer is to issue directions to the Board for expeditious disposal of the stay application. 2. From perusal of the documents provided during course of hearing, it is forthcoming that the petitioner has impleaded newly added respondents as party on 10.01.2025 and they are yet to be served. 3. This petition is disposed of with liberty to the petitioner to approach the Board for expeditious disposal of the stay application along with the prayer for ‘dasti’ summons for newly added respondents. 4. There is no doubt in eventuality of such request being made, the Board shall consider the stay application after completion of service as expeditiously as possible taking into account that third parties are being created which will further create complications.
