HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous (Petition) No.8069/2024 Jitendra Son Of Shri Harikesh Meena, Resident Of Badoli, Gastin Ka Pura, Bajirpur, District Sawai Mahopur (Raj). ----Petitioner Versus 1. State Of Rajasasthan, Through Public Prosecutor. 2. Santosh Kumar Son Of Shri Prithviraj Meena, Resident Of Bijalpur, Police Station Kudgganv, District Karauli (Raj). ----Respondents For Petitioner(s) : Mr. Rajendra Singh For Respondent(s) : Mr. Jitendra Singh Rathore, PP JUSTICE ANOOP KUMAR DHAND Order 07/01/2025 1. By way of filing this petition, the petitioner is seeking directions to the Additional Sessions Judge No.1 Gangapur City District Sawai Madhopur to decide the Sessions Case No.40/2022 expeditiously as early as possible. 2. Learned counsel for the petitioner submits that after recording the statement of the accused under Section 313 Cr.P.C., the case was posted for 08.04.2024 for final arguments but on the next date time was sought by the other side. Hence, the case was posted for 07.05.2024 but on the said date the Presiding Officer was transferred. Learned counsel submits that subsequently after posting of the new Presiding Officer on several dates i.e. 14.06.2024, 30.07.2024, 12.08.2024, 30.08.2024, 09.09.2024, 11.09.2024, 17.09.2024, 30.09.2024, 15.10.2024 and 05.11.2024 the case was posted for final arguments but till date final (2 of 2) [CRLMP-8069/2024] arguments have not been heard and the case has not been decided now the next date before the trial court is 04.02.2025. Learned counsel submits that, under these circumstances, a direction be issued to the trial court to speed up the proceedings of the case pending before it and pass final order. 3. Considering the above factual aspect of the matter and looking to the fact that the case is lying at final stage for want of final arguments since 08.04.2024 and, thereafter, more than nine months have passed, it is expected from the learned trial court to make all possible endeavours to hear the final arguments on the next date and if not possible then by posting short date and pass final order after hearing the other side strictly in accordance with law. 4. Accordingly, the criminal misc. petition stands disposed of. (ANOOP KUMAR DHAND),J Karan/145
