Private opposite party is not represented. In this application petitioner has prayed for a direction upon the court below for expeditious disposal of GR Case No. 4761 of 2019 presently pending before learned Additional Chief Judicial Magistrate, Berhampore, Murshidabad. Being aggrieved by the inordinately delay caused in disposal of the said proceeding, learned counsel for the petitioner submits that the FIR was registered on 10.11.2019 and after completion of investigation the charge-sheet was submitted on
11.12.2019. Thereafter, on 30.01.2021 charge was framed against the present petitioner where the prosecution proposes to examine six witnesses but till date not a single witness could be examined and as such he prays for necessary direction. Having heard learned counsel for the petitioner and the State, it appears that the prayer made by the petitioner is innocuous and, if it is allowed in terms of the prayer made in the petition, the private opposite party or the State will have no cause to prejudice and as such, service of copy of application upon the private opposite party or the State is dispensed with.
2 Having considered the submissions made by learned counsel for the petitioner it appears that the proceeding has practically got stalled for more than five and half years. I am further informed that next date is fixed on
08.06.2027. Therefore, I find that the prayer made on behalf of the petitioner for preponing the date and for direction upon the court below for early disposal of the proceeding is justified and required to be allowed to secure the ends of justice. In view of above, CRR 4157 of 2025 is hereby disposed of with a direction upon the court below to prepone the date and to fix a date for recording evidence of prosecution witnesses in the month of October, 2026 and thereafter he will make his best endeavour to conclude the trial within a period of six months thereafter. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
