ORDER:
This Writ Petition is filed by the Petitioner seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief:
“ .... to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, to declare the inaction of the Police in considering the representation dt.20.11.2023 made by the Petitioner against the unofficial Respondents, in pursuance of decree dt.25.06.2013 in O.S.No.634 of 2009, as illegal, arbitrary, against in violation of principles of natural justice and against all settled principles of law and consequently direct the Respondents Police to consider the representation dt.20.11.2023 made by the Petitioner for police aid against the unofficial Respondents, in pursuance to decree dt.25.06.2013 in O.S.No.634 of 2009 and to pass ...”

Heard learned counsel for the Petitioner and learned Assistant Government Pleader for Home appearing for respondent/Police. Perused the material on record. 3. Learned counsel for the Petitioner would submit that the Petitioner has filed a suit in OS No.634 of 2009 on the file of the Court of I Additional Judicial First Class Magistrate, Kurnool and obtained an order of injunction and thereafter, obtained a decree of permanent injunction on 25.06.2013 against the unofficial respondents. Aggrieved thereby, unofficial respondents herein preferred an appeal and succeeded in the appeal. Learned counsel would further submit that being aggrieved by the Judgment of the lower Appellate Court, Petitioner preferred Second Appeal No.1631 of 2018 before this Court and the same is pending adjudication. 3

Learned Assistant Government Pleader for Home would submit that since the subject matter pertains to civil in nature and that respondent Police could not provide police protection to the Petitioner without there being any Court orders. 5. Considering the submissions, liberty is granted to the Petitioner to work out the remedy before appropriate forum having jurisdiction according to law. 6.
