Case No.18 of 2025 dated 16.01.2025 under Sections 21(c)/25/29 of the NDPS Act, 1985. And In the matter of: Rahul Mondal … petitioner Mr. Tapodip Gupta … for the petitioner Mr. Sandip Chakraborty Mr. Sufi Kamal … for the State Learned counsel for the petitioner submits that the only material available against the petitioner is the statement of a co-accused which is inadmissible in evidence. Learned counsel for the State files a report which is taken on record and opposes the prayer for anticipatory bail and submits that apart from the statement of the co-accused there is a criminal antecedent of the petitioner. A charge- sheet has been submitted. Considering the materials available in the case diary and the fact that the petitioner has a criminal antecedent and in view of the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail. 2 The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities. (Jay Sengupta, J.)
