3. The present Review Petition has been filed against the judgment dated 16.07.2025, passed in LPA No. 410 of 2025, titled Union of India & Ors. vs. M/s Himtex Textiles Pvt. Ltd. & Anr., which arose out of the judgment dated 20.03.2025, passed in CWP No. 8227 of 2024, filed by the
2 2025:HHC:39843 present petitioner i.e. M/s Himtex Textiles (P) Ltd. The petitioner is primarily aggrieved on the ground that he had challenged the
order dated 14.06.2024 whereby representation for registration under IDS 2017 has been rejected.

Petitioner submits that on an earlier occasion, he had filed CWP No. 8625 of 2023 wherein directions were issued that since the petitioner’s application for registration under Industrial Development Scheme was pending adjudication its application be considered in the term of said scheme within a period of four weeks. The rejection order had been passed on 14.06.2024, which was sought to be challenged in the subsequent writ petition bearing registration No. CWP No. 8227 of 2024. The same however was disposed of on 20.03.2025, in view of an
order passed by the learned Single Judge of this Court in CWP No. 10600 of 2024, titled as Atul Sharma vs. Union of India & Ors., decided on 06.01.2025, wherein, ‘in principle’ the matter was to be placed before the Empowered Committee chaired by Secretary, Department of Industrial Policy & Promotion in terms of Clause 6.1 of the Scheme for registration without being influenced by the letters dated 09.11.2023 and 30.07.2024.
5. The matter did not rest there. The Union of India challenged the said order in LPA No. 410 of 2025 and clubbed the appellant’s case with LPA No. 169 of 2025, titled as Union
3 2025:HHC:39843 of India vs. Atul Sharma & Ors. The matter as such was
disposed of by upholding the order of the learned Single Judge that individual case has to be considered afresh by the Empowered Committee and the needful was to be done within four months.

It is, thus, his grouse that his case was different as such, as there was already a rejection order dated 14.06.2024, which was wrongly taken up firstly before the learned Single Judge and also when the matter was disposed of by us on 16.07.2025 in the bunch matter or by either of the parties including the review petitioner and the Union of India.

Counsel for the petitioner has also pointed out that similar decision as such had also been done by the Union of India while rejecting the case of Atul Sharma on 20.06.2025 by the Empowered Committee and the liberty had been given to Atul Sharma in the said order to challenge the said decision on merits. It is, thus, submitted that the review petitioner would also be entitled for same treatment.
8. Counsel for the Union of India and State are not in a position to oppose the same, in view of the above facts since apparently there is already an order of adjudication passed on
14.06.2024. It is also not disputed that Atul Sharma has also filed a separate writ petition being CWP No. 12739 of 2025,
4 2025:HHC:39843 challenging the rejection dated 28.06.2025, which is also pending adjudication.
9. Resultantly, we dispose of the present Review Petition in the aforesaid terms by giving liberty as such to the petitioner to challenge the order dated 14.06.2024 in an independent proceedings. The order dated 16.07.2025 in LPA No. 169/2025 and LPA No. 410/2025, passed in the bunch of cases, as such, would not stand in his way or the earlier order dated 20.03.2025, passed by the learned Single Judge in CWP No. 8227 of 2024, which was subject matter of consideration in LPA No. 410 of 2025.
10. With the above observations, the present Review Petition is disposed of, so also pending applications, if any.
