2. The petitioner has been made accused in connection with Jaldega (Bansjor O.P.) P.S. Case No. 54/2024, for the offences registered under Sections 20(b) (ii), 22(b) of the N.D.P.S. Act, 1985, pending in the Court of learned Sessions Judge-cum-Special Judge, Simdega.
3. On 21.10.2024, at about 08:00 P.M., Jaldega (Bansjor O.P.) Police apprehended this petitioner alongwith two other co-accused persons. On search, 9.42 Kgs. Of cannabis were recovered from their joint possession.
4. It was submitted that the quantum of seized cannabis comes within the purview of intermediary quantity. It was further submitted that the petitioner has got no criminal antecedent and this fact has been mentioned at Paragraph- 14 of this Bail Application. It was finally submitted that co-accused Tulsi Mishtri and Surendar Kumar have been granted bail by this Court earlier.
5. Mr. Bhola Nath Ojha, learned Special P.P. has opposed the prayer for bail, but does not dispute the aforesaid facts.
6. In view of the submissions made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge-cum-Special Judge, Simdega in connection with Jaldega (Bansjor O.P.) P.S. Case No. 54/2024.
