NC: 2025:KHC:16482 CRL.P No. 10872 of 2024
2. The 2nd respondent lodged the first information report(FIR) alleging that, the petitioner-accused No.1 husband, and other accused are the relatives of the petitioner-accused No.1, and they subjected the defacto-complainant to cruelty, both mentally and physically, and also a demand was made to bring money from the parental home.
3. Petitioner-accused No.1 and respondent No.2- defacto-complainant are present before this Court and have produced the certified copy of the decree passed in M.C.No.52/2022, wherein, the marriage of the accused No.1 with the defacto-complainant has been dissolved mutually, and accused No.1 has agreed to pay a sum of Rs.50,00,000/- towards permanent alimony and has already paid to the respondent No.2-defacto-complainant. The respondent No.2 who is present before this Court has agreed to withdraw all the allegation and has no objections for quashing the impugned FIR
4. The order sheet as well as the statement of respondent No.2 is placed on record.
5. Though the offences alleged against the petitioners –accused are cognizable and non-compoundable, however, having regard to the fact that the parties have amicably resolved the dispute among themselves, and the respondent No.2 having no objection for quashing the impugned FIR, it would be a futile, the Police filing the charge sheet is remote and bleak in view of the settlement. Therefore, the continuation of the investigation will be an abuse of process of law. Accordingly, I pass the following:
