PUBLIC PROSECUTOR (AP) The Court made the following: ORDER: This Criminal Petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings in FIR.No.200 of 2021, dated 23.09.2021 on the file of Maddipadu Police Station, Prakasam District. 2. When the petition came up for hearing on 29.12.2021, this Court has passed the following order: “…Learned counsel for the petitioner further submitted that in fact the petitioners have filed a suit under section 19 of the Trade Marks Act for infringement and the Court has also granted interim injunction in that suit. Considering the said submissions, there shall be stay of all further proceedings in F.I.R.No.200/2021 of Maddipadu police station, Prakasam District.” 3. Today when the matter came up for hearing, learned counsel for the 2nd respondent has submitted that the petitioners have filed a suit vide O.S.No.187 of 2022 on the file of 16th Additional District Judge, Ranga Reddy under Section 19 of the Trade Marks Act and the same is pending for adjudication. He further brought to the notice of this Court that though the petitioners have filed the aforesaid suit, no interim injunction was granted in the said suit as submitted by learned counsel for the petitioners on 29.12.2021. 4. In view of the same, instead of keeping the present petition pending, this Court feels it appropriate to dispose of the same by directing the Police to complete the investigation as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order. It is made clear that till the investigation is completed, no coercive steps shall be taken as against the petitioners 5. Accordingly, this criminal petition is disposed of.
