In view of the submission made hereinabove, it is most humbly prayed that present petition may kindly be allowed and impugned order dated 27.01.2025 (Annexure P-9), may kindly be quashed and set-aside in the interest of justice and fair play. ii. that the respondent may kindly be directed to grant NOC/Essentiality Certificate for opening Nursing Institute, in favour of the petitioner Society in time bound manner.” 2. By referring to the pleadings, learned Counsel for the petitioner submits that the case of the petitioner was not being pursued by the Authorities on the ground that a complaint was received from one of the owners of the adjoining land, namely 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:39782 Aashish Jaswal, that the College stood constructed on his land without his permission/ NOC. Learned Counsel has handed over a copy of the Compromise that has been entered into between the parties in the civil litigation going on between them, which is ordered to be taken on record and he prays that in light of this development now the Authority be directed to take a call on the case of the petitioner. 3. Learned Additional Advocate General submits that let the petitioner apprise the Authority concerned of this development by filing an appropriate application alongwith which the order passed by the Court be also appended and thereafter, the Authority shall deal with the matter expeditiously. The petitioner to do the needful within one week from today and thereafter, appropriate call be taken on the prayer of the petitioner within three weeks. 4. The petition stands disposed of.
