By means of the present writ petition, petitioner has put to challenge the FIR dated 04.02.2025 lodged by respondent no.4 in Case Crime No.05 of 2025 at P.S. Reethasaheb, District Champawat, under Sections 8/21/27/29/60 of the NDPS Act. 4. By previous order dated 05.03.2025, learned State Counsel was directed to seek instructions in the matter for the reason that the petitioner submitted before this Court that the police is harassing him, inasmuch as, five FIRs under Sections 8/21/27/29/60 of NDPS Act were lodged against the petitioner. 5. Today, State Counsel supplied the instructions dated 05.03.2025 to the Court, which are taken on record. On instructions, it is submitted by learned State Counsel that petitioner was named by co-accused as well as by other witness, namely, Karan Prasad, therefore, petitioner is wanted in the aforesaid FIR. 6. From perusal of the first information report, it transpires that the allegations made in the first information report are very serious and discloses commission of offence. Hence, this Court does not want to interfere in the impugned FIR by exercising discretionary jurisdiction under Article 226 of the Constitution of India. Accordingly, the writ petition is 2 dismissed in limine. 7. Pending application, if any, stands disposed of accordingly. (Pankaj Purohit, J.) 07.03.2025 AK
