SREENIVASA REDDY Criminal Petition Nol307 of 2025 Order: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner herein/accused, seeking regular ba'll, in Crime No.269 of 2024 of Banaganapalli P6I'lce Station, Nandyal District, registered for the offences punishable under Sections 106(1) and 124(a) of the BNS. 2. Case of the prosecution, in brief, is that on 23.12.2024, the defacto compla'lnant filed a report before the police stating that an un-known person drove a car in a rash and negligent manner with h'lgh speed proceeding from Goofy s'Ide tO Banaganapalle town side and dashed his father and two others, Thereafter, they were shifted to Government Hospital, Banaganapalle, On examination, the doctors informed that the father of the defacto compla'lnant died and two others were shifted to Kurnool for better treatment. 3. Heard. Perused the record. 4. A perusal of the material on record goes to show that the petitioner was arrested on 24.12.2024 and since then has been in judicial custody. It is represented by the learned counsel for the petitioner that the police filed a custody petition before the Jurisdictional Court and the same was dismissed by the Court. It js submitted by the learned Assistant public prosecutor that at the tl'me of the accident, the petitioner was in a drunken condition. Except the submjssjon made by the learned Assistant publI'C Prosecutor, there js no other material to show that the petI'tjOner was in a drunken condI'tl'On at the time of accl'dent. 5. In view of the aforesaid facts and circumstances of the case and consl'dering the period of detention, th,-s court is inclined to consider request of the petI'tjOner herein for grant of bail. 6l Accordingly, the criminal petition I-s allowed.
