THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioner seeks for the following reliefs: "WHEREFORE it is humbly prayed that this Hon'ble Court be pleased to quash the entire proceedings in Crime No.014/2023 (S.C.No.1093/2023) dated 06.02.2023 arising out of the complaint lodged by the second respondent for the offences punishable under - 3 - HC-KAR NC: 2025:KHC:20480 CRL.P No. 10827 of 2024 Sections 376, 354, 37 & 511 of Indian Penal Code 1860 registered by Vivek Nagar Police Station, Bangalore against the Petitioner pending on the file of the learned Principal City Civil & Sessions Judge at Bangalore to meet the ends of Justice." 2. A perusal of the material on record will indicate that the 2nd respondent - defacto complainant instituted the aforesaid proceedings against the petitioner for the offences punishable under Sections 376, 354 and 37 of IPC which is presently pending in Cr.No.14/2023 (S.C.No.1093/2023) before the Principal City Civil and Sessions Judge, Bengaluru. 3. The petitioner and the respondent Nos.2 and 3 have filed a joint memo for settlement which reads as under: "The Petitioner and Respondent Nos.2 and 3 respectfully submit this Joint Memo before this Hon'ble Court as under: 1. The Petitioner (Mr. Adithya Abhiraj) and the Respondent No.2 (Ms. Ruchita Kumari) and Respondent No.3 (Ms. Saloni Gupta) submit that the dispute between them which gave rise to the - 4 - HC-KAR NC: 2025:KHC:20480 CRL.P No. 10827 of 2024 registration of FIR in Crime No.14/2023 registered by the Respondent No.1 - Vivek Nagar Police Station, for the alleged offences under Sections 376, 354, 37 & 511 of IPC, which is now pending in S.C.No.1093/2023 before the Court of the Principal City Civil and Sessions Judge (CCH-54), Bengaluru, has been amicably settled between the parties. 2. It is submitted that the parties have resolved their differences voluntarily, without any coercion, inducement, or undue influence from any corner, and have decided not to pursue the matter any further. 3. Respondent Nos.2 and 3, the complainants in the above-mentioned case, have no objection to the quashing of the proceedings against the Petitioner (Accused No.2) in light of the settlement arrived at between the parties. 4. The parties respectfully submit that continuation of the criminal proceedings would serve no useful purpose and may unnecessarily result in hardship and harassment to both sides. - 5 - HC-KAR NC: 2025:KHC:20480 CRL.P No. 10827 of 2024 5. In view of the amicable settlement between the parties, the Petitioner and Respondent Nos.2 and 3 pray that this Hon'ble Court may be pleased to quash the FIR in Crime No.14/2023 and all further proceedings in S.C.No.1093/2023 pending before the Principal City Civil and Sessions Judge (CCH-54), Bengaluru, insofar as the Petitioner (Accused No.2) is concerned, in the interest of justice and equity. WHEREFORE, the Petitioner and the Respondent Nos.2 and 3 respectfully pray that this Hon'ble Court may be pleased to: a) Take this Joint Memo on record. b) Quash the FIR in Crime No.14/2023 registered by Vivek Nagar Police Station and the proceedings in S.C.No.1093/2023 pending on the file of the Principal City Civil and Sessions Judge (CCH-54), at Bengaluru, insofar as the Petitioner (Accused-No.2) is concerned; and c) Pass such other order(s) as this Hon'ble Court may deem fit in the facts and circumstances of the case, in the interest of justice." - 6 - HC-KAR NC: 2025:KHC:20480 CRL.P No. 10827 of 2024 4. In view of the aforesaid settlement arrived at between the petitioner and the respondent Nos.2 and 3 who are physically present before the Court along with their learned counsels, I am of the considered opinion that the present petition deserves to be allowed and disposed of in terms of aforesaid joint memo of settlement and the impugned proceedings deserves to be quashed. 5. In the result, I pass the following: ORDER i. The petition is disposed of in terms of the joint memo. ii. The impugned proceedings in S.C.No.1093/2023 (arising out of Cr.No.14/2023) on the file of the Principal City Civil and Sessions Judge, Bengaluru are hereby quashed. iii.
