Elam Robindro Singh …Respondent/s -B E F O R E- HON'BLE MR. JUSTICE AHANTHEM BIMOL SINGH 14.08.2026 [1] Ms. S. Nikita, learned counsel appeared on behalf of the applicant and Mr. A. Sachikumar, learned counsel appeared on behalf of the respondent. [2] The present application has been filed with the prayer for condoning the delay of 73(seventy three) days in preferring the accompanying appeal filed against the judgment and order dated 05.11.2024 passed in Original (Probate) Suit No.4 of 2013 of 2013/1 of 2016 in the Court of District Judge, Imphal West, Manipur. [3] I have heard the submission advanced by learned counsel appearing for applicant as well as learned counsel appearing for the respondent. [4] I have also carefully perused the explanation given by the applicant for condoning the aforesaid delay. [5] Mr. A. Sachikumar, learned counsel appearing for the respondent submitted that for the period from 25.01.2025 till the date of filing the present condonation application as well as the KABORAMB AM SAPANA CHANU Digitally signed by KABORAMBAM SAPANA CHANU Date: 2026.08.14 17:24:42 +05'30' MC(RFA) No.3 of 2025 Page 2 accompanying appeal, no sufficient explanation has been given by the applicant. However, the learned counsel fairly submitted that the present condonation application may be allowed subject to payment of cost. [6] Considering the fair submission advanced by the learned counsel appearing for the respondent, this Court is of the considered view that it will be in the of interests of justice to condone the aforesaid delay and to heard the connected appeal on merit. Accordingly, the present application is allowed subject to payment of cost of Rs. 3,000/-(Rupees three thousand) only to be paid by the applicant to the lone respondent. The said payment should be made within a period of 2(two) weeks from today. [7] Subject to the aforesaid observation and direction, the present application is allowed by condoning the delay of 73 days in preferring the aforesaid accompanying appeal. Misc.
