It is contended by learned counsel for the petitioner that petitioner has falsely been implicated in this case. Counsel also submits that petitioner has been made accused simply on the basis that petitioner is the wife of accused-Gaurav Jain with whom complainants were doing the business activity. Counsel further submits that petitioner, who is a female is facing Magistrate trial. Charges were framed on 24.10.2024 and first date for recording the prosecution evidence was fixed as 07.11.2024. Counsel submits that as per Section 437(6) Cr.P.C.[480(6) BNSS] it is mandatory for trial court to conclude the trial within a period of 60 days from the first date fixed for recording the prosecution evidence. Counsel submits that delay in conclusion of trial is not attributed to the petitioner. Trial will take time in its conclusion and further custody of the petitioner would not serve any fruitful purpose. 3. Learned Public Prosecutor has opposes the submissions made by counsel for the petitioner. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, as also considering the fact that petitioner is facing Magistrate trial; that petitioner is in custody since 13.08.2024 and she is a female and trial will take time in its conclusion, I deem it proper to allow the bail application. 6.
This bail application is accordingly allowed and it is directed that accused-petitioner Smt. Tripti Jain W/o Shri Gaurav Jain, shall be released on bail provided she furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that she shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
