1. Petitioners are defendant Nos. 1 & 2 before the learned Trial Court and are aggrieved by the order dated 04.03.2025 passed in Original Suit No. 59 of 2024, whereby and whereunder, ad interim order of status-quo has been allowed in favour of the plaintiffs till appearance of the parties.
2. Plaintiffs filed a partition suit with respect to Schedule-A property over which Petitioners/defendants claim to have acquired title on the basis of registered sale deed executed on 29.05.2019 by Mahalaxmi Devi (defendant no.3).
3. Plaintiff filed a petition under Order XXXIX Rule 1 and 2 of CPC for

ad interim injunction which has been allowed by the impugned order when these petitioners had not entered into appearance. It was clarified that the order of status-quo is allowed till the appearance of the parties.
4. It is contended that all the defendants have appeared and, therefore, prayer is made for direction to the learned Trial Court for disposing of the petition after hearing both the sides.
5. On perusal of the record of this case, it appears that the order of status- quo, was interim in nature till the appearance of the parties and the final
order was to be passed after the appearance of all the parties.
6. Since now the appearance is complete, therefore, learned Trial Court is
directed to pass final order on the petition dated 21.01.2025 filed by the plaintiffs, after hearing the parties, within a period of three months from the date of receipt/production of copy of this order.
This civil misc. petition stands disposed of. Pending I.A., if any, also stands disposed of.
