1. The petitioner has been filed this writ petition on the following relief(s) :
“10.1. This Hon'ble Court may kindly be pleased to call the records of the case for the kind perusal of this Hon’ble Court.
10.2. This Hon'ble Court may kindly be pleased to issue an appropriate writ or order and direction to the respondent authority to initiate the proceeding for pay compensation to the petitioner in respect of land categorically mentioned in the petition or to vacate and return the encroached portion of land to the petitioner.
10.3. Any other relief deemed fit in the facts and circumstances of the case may also be granted.”

Learned counsel for the petitioner contended that the present petition is not being filed against any particular order but is being filed for purpose of issue direction to respondent to take due action in respect of the petitioner and about his land. The land bearing Khasra No.837 is situated at Patwari Halka No.08 Revenue Nigam Mandal Gariyaband Village Paragon total Rakba 2.0200 Hectere under ownership of the petitioner. The respondent No. 4 to 6 without initiating any land
3 acquisition proceeding encroached on the land of the petitioner and not providing any compensation in this regard though the respondent are corresponding to each other but not giving the compensation.
3. Learned counsel for the respondents oppose the submission made by
learned counsel for the petitioners.
4. I have heard learned counsel for the parties and perused the record with utmost circumspection.
5. Considering the facts and circumstances of the case and submission made by learned counsel for the parties, at this stage this writ petition is disposed of directing to respondents No.2, 4 & 6 to consider and decide the pending application/representation submitted by the petitioner dated 04.04.2005 (Annexure P/3) within a period of ‘45 days’ from the date of receipt of copy of this order as per rules, regulations and law and on its own merits.
6. Accordingly, the instant petition is disposed of.
