Neutral Citation No. - 2025:AHC:131832 Court No. - 34 Case :- WRIT - C No. - 7877 of 2024 Petitioner :- Thakur Rangji Maharaj Virajman Mandir Respondent :- State Of Up And 3 Others Counsel for Petitioner :- Devansh Misra Counsel for Respondent :- C.S.C. Hon'ble Rohit Ranjan Agarwal,J. Personal affidavit filed by Registrar, Board of Revenue, Prayagraj is taken on record. This writ petition was filed with the following prayer:- "(1) Issue a writ, order or direction in the nature of Mandamus commanding the Respondent nos. 3 and 4 to disburse the amount of annuity of Rs. 3,52,080/- as determined under Section 99 of the UPZA&LR Act, 1950 for the period beginning from 01.01.2020 to 31.12.2023 along with interest @18% per annum;" After the indulgence of this Court, the State Government had proceeded to identify 978 trusts throughout the State of U.P. According to Sri Rajeshwar Tripathi, learned Chief Standing Counsel, the outstanding payment of the annuities had been made to the trusts. According to him, out of 978 trusts, 130 accounts of the trusts have been verified and uploaded on the e-portal. He further submits that bank details have been provided by 186 trusts, but rest of the 56 accounts could not be verified. He further submits that the Collector of each district had requested all the trusts to provide the bank accounts, and get it uploaded on the e-portal so that the annuity is directly paid into the account of the trusts. After hearing counsel for the parties and perusing the material on record, I find that the prayer made in the writ petition has already been granted. Through writ petition the State Government was required to pay the annuities to all the religious trusts throughout the State of U.P. whose land was acquired after the U.P.Z.A. & L.R. Act, 1950 was implemented, and the State has come out with a policy and 130 bank accounts of the trusts have been verified and amount has already been transferred and there remains no payment to be made by the State Government for the outstanding, for which, the writ petition was filed. This Court finds that substantial compliance has been done by the State Government. Accordingly, writ petition stands disposed of. However, in case, any trust finds that any account and annuity remains outstanding and has not been paid by the State Government, it may apply before this Court by moving a recall application.
