Petitioner has been made an accused in connection with Chhotanagra P.S. Case No. 10(S)/2022, Corresponding to NDPS Case No.14/2024, registered under sections 21/22 of the N.D.P.S Act, 1985, pending in the court of learned Sessions Judge, West Singhbhum, Chaibasa. On 25.07.2022, on the basis of confidential information Chhotanagra Police intercepted a Swift Dzire bearing registration no. JH-05-Z- 0296 and on search 108 Kgs of cannabis were recovered from the said vehicle. It was submitted that the petitioner was neither apprehended at the spot nor anything was recovered from his possession. It was further submitted that similarly situated co- accused has been granted bail by this court earlier. Learned Special P.P. has opposed the prayer for bail and submitted that the name of the petitioner has transpired in the confession of co- accused.
Regard being had to the facts and circumstance of the case and considering the nature of allegation, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, West Singhbhum, Chaibasa in connection with Chhotanagra P.S. Case No. 10(S)/2022, Corresponding to NDPS Case No.14/2024.
