The petition/Appeal coming on for hearl'ng, upon perusing the petition and the grounds filed in support thereof and upon hearing the arguments of Sri ARUN SHOWRI G Advocate for the petitioner, PUBLIC PROSECUTOR (AP) for the Respondent and the court made the followl-ng. 1 I, THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 310 of 2025 ORDER: The Criminal Petition, u/See.482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner/A3 to grant anticipatory bail in connection with Crime No.310/2024 of Medikonduru Police Station, Guntur District. 2. A case has been registered against the petitioner and others for the offences punishable under Sections 318(4), 316(5) read with 3(5) B.N.S. 3. The case of the prosecution in brief is that: The defacto complainant namely Thotakura Srinivasarao, Assistant Director of Agriculture, Guntur gave a report to police stating that there are irregularities in payment of input subsidies to farmers of Medikonduru Mandal wherein an enquiry team re-verified the enumeration lists in respect of several villages and reported irregularities amounting to Rs.19,46,272/- finding that ineligible farmers in Velavarthipadu village had received input subsidies. consequently, a crime was registered against three accused, including the petitioner, who is a cotton buyer by profession, against whom the accusation is that he illegally enrolled I-neligible farmers in the enumeration list, driven by vested interests and a desire for personal gain. `&=- in-I? 4. Heard. Perused the record. 5, A perusal of the material available on record goes to show that certain instances were found where ineligible beneficiaries Were deliberately recorded as tenant farmers, who are not the actual cultivators. They are only agricultural labourers. These individuals are wrongly identified as farmers and subsidies were credited to their accounts though they are ineligible. On coming to know about the fact, they were explained wl'th regard to the consequences. Accordingly the ineligible farmers returned the amount to the enquiry team under proper acknowledgment. 6, The accusation as against the petitioner is that he is alleged to have collected money from the farmers. Learned Ass'lstant Public Prosecutor submitted that as the farmers have not come forward, they were not examined and some of the farmers, who were examined, did not state that the commissions were given to the petitioner herein. ln view of the same, this court is incl-lned to grant the prayer of the petitioner/A3 for grant of anticipatory bail. 6. Accordingly, in the event of his arrest with regard to this crime, petitioner/A3 shall be released on bail on his executing a personal bond for a sum of Rs.1O,000/_ (Rupees ten thousand Only), With two Sureties each for the like sum to the satisfaction of the arresting police officials € L_ E and also on condition that the petitioner shall make himself available for investigation as and when required and that he sha" not cause any threat, inducement or promise to the prosecution witnesses. The petitioner shall appear before the concerned station House Officer, once in a week i.e. on every sunday between 10.00 a.m. and 05.00 p.m., till filing of the charge-sheet. 7.
