The respondent-plaintiff had filed a suit for declaration challenging the annual confidential report for the period from 01.04.1986 to 31.03.1987 and the rejection of the representation made against adverse remarks recorded in the ACR with a request to expunge the said remarks. The said suit was decreed by the trial Court and the appeal filed by the State was dismissed. 2. A perusal of the paper book would show that there is no interim order in favour of the appellants-State and in all probability, the respondent would have retired. 3. None has appeared on behalf of the respondent to inform as to whether any cause survives.
