After arguing for some time, learned counsel for the petitioner submits that after filing of the instant petition, petitioner has been acquitted of the charges levelled against her by the Co-ordinate Bench of this High Court vide order dated 30.11.2022 passed in CRR No.914/2019. He further submits that after getting acquittal, petitioner has filed the application for reinstatement of her employment, but the same has not been decided yet, therefore, he seeks permission of this Court to withdraw this petition with liberty to file a fresh and DEEPTI JHA NIRALA Digitally signed by DEEPTI JHA NIRALA 2 duly constituted petition, if occasion arises. He further submits that respondent authorities may be directed to consider and decide the application filed by the petitioner for her reinstatement in the employment. 3. State counsel has no objection with regard to the submission made by the counsel for the petitioner, so far as it relates to the withdrawal of the petition with liberty, as sought for. He further submits that if petitioner files fresh representation in respect of reinstatement in the employment after her acquittal, then it shall be considered and decided in accordance with law. 4. On due consideration, prayer made by the counsel for the petitioner is allowed. Permission as sought for, is granted. 5. Accordingly, instant petition is dismissed as withdrawn with the aforesaid liberty. 6. It is further observed that petitioner may file fresh representation seeking her reinstatement in employment, as it is informed by the petitioner that she has already been acquitted by this Court in aforesaid case vide order dated 30.11.2022. If, petitioner files such fresh representation before the respondent authorities, then respondent authorities/competent authorities shall consider and decide the same within a period of 90 days from the date of receipt of representation along with a copy of this order. 7.
