He contends that the petitioner is in custody since 03.06.2023, challan has already been presented in Court and as per allegations levelled in the FIR, the injury attributed to the petitioner is simple with blunt weapon, which cannot be construed as dangerous to life in any manner. The conclusion of trial will take sufficient long time, hence, prayed for grant of concession of regular bail to the petitioner. 5. Per contra, learned State counsel referring to the reply submitted by the State has opposed the bail petition on the ground that petitioner had actively participated in the occurrence, wherein he along with co-accused had attacked the complainant with an intent to kill him, however, on query he clarified that the injury attributed to the petitioner is injury No.1 which has been found simple and caused with blunt weapon. 6. After considering the rival contentions and perusing the record, it transpires that as per the allegations levelled against the petitioner, he had caused injury with reverse side of axe on the complainant and the said injury has been found simple in nature, caused with blunt weapon. The injury attributed to the petitioner is not construed dangerous to life. The petitioner is not having any criminal antecedents and is in custody since 03.06.2023, after completion of investigation, challan has already been presented in Court, wherein prosecution has cited 21 witnesses and till date none of them have been examined. The conclusion of trial to ascertain criminal liability, if any, of the petitioner will take sufficient long time, as such, no purpose would be served by detaining the petitioner in custody any longer. 7.
