2. This Criminal Miscellaneous Petition has been filed invoking the jurisdiction of this Court under Section 482 of the Code of Criminal Procedure with the prayer to quash the FIR as well as the entire criminal proceedings in connection with Basia P.S. Case No.40 of 2022.
3. Learned counsel for the petitioner submits that though after investigation of the case, the charge sheet has already been submitted, cognizance has already been taken, charge has already been framed and three witnesses have already been examined in this case but without bringing on record either the charge sheet or the cognizance order or the deposition of the witnesses, the petitioner wants to quash the FIR and the consequential proceedings including the charge sheet and the cognizance.

Considering the facts of this case, since admittedly charge has already been framed consequent upon submission of charge sheet and cognizance has been taken and three witnesses have already been examined, but the copy of the depositions of such witnesses, has not been brought on record, this Court has no hesitation in holding that the petitioner has not come to court with clean hands. Since the trial has been substantially progressed, this is not a fit case to quash the FIR when the chargesheet, the order taking cognizance and the order framing charge are neither being challenged nor being brought on record; deliberately by the petitioner.
5. Accordingly, this Criminal Miscellaneous Petition, being without any merit, is dismissed.
