Case No. 16 of 2025 (POCSO Case No.77 of 2025), for the offences registered under Sections 137(2)/96 of the B.N.S., 2023 and Section 4 of the POCSO Act, pending in the court of learned Special Judge, POCSO Act, Giridih. Petitioner is alleged to have kidnapped the minor daughter of the informant aged about 16 years. Statement of the victim was recorded under Section 183 of the B.N.S.S., in which, she has stated that she was kidnapped by the petitioner. She has further stated that she was confined in a room where the petitioner raped her. Learned counsel for the petitioner submitted that there is a delay of four days in lodging of the F.I.R. It was further submitted that the medical report does not support the allegation. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail.
