Atru, District Baran, At Present Swami Vivekanand Nagar, In Housing Board Ke Makan P.s. R.k. Puram, Kota. (At Present Central Jail, Kota). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Mukesh Sharma For Respondent(s) : Mr. N.S. Dhakar, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 23/01/2025
1. The second bail application has been filed under Section 483 of BNSS, on behalf of the petitioner, who has been arrested in connection with FIR No.328/2024 registered at Police Station R.K. Puram, District Kota City for the offences punishable under Sections 126(2), 115(2), 109(1) & 3(5) of BNS and Section 3(2) (va) of SC/ST Act. Charge-sheet has been filed for offences under Sections 126(2), 115(2), 109(1), 118(1), 118(2) & 3(5) of BNS. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. Counsel submits that as per the FIR, which has been registered on the basis of ‘parcha bayan’ of the victim, allegation of causing knife injury is against co-accused Ram Chopra. Learned counsel
[2025:RJ-JP:3495] (2 of 3) [CRLMB-14957/2024] submits that after thorough investigation, police submitted charge-sheet. It is submitted that petitioner has no criminal antecedents and he is in custody since 01.10.2024. Trial will take time in its conclusion and further custody of the petitioner would not serve any fruitful purpose. 3. Per contra, learned Public Prosecutor opposes the bail application. He submits that petitioner is duly named in the FIR and he has also actively participated in commission of crime. 4. Despite information, none has put in appearance on behalf of the victim/complainant to oppose this bail application. 5. I have considered the contentions. 6.
Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, especially the fact that no role has been attributed to the petitioner; allegation of causing knife injury is against co-accused; petitioner has no criminal antecedents and he is in custody since 01.10.2024; charge-sheet has been filed and trial will take time in its conclusion, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application. 7. This bail application is accordingly allowed and it is directed that accused-petitioner Lokesh Mahawar @ Yogesh S/o Ramprasad, shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that he shall appear
[2025:RJ-JP:3495] (3 of 3) [CRLMB-14957/2024] before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. (ANIL KUMAR UPMAN),J CHARU SONI /270
