2. The petitioner is apprehending his arrest in connection with Panki P.S. Case No. 13 of 2025 arising out of N.D.P.S. Case No. 09 of 2025, registered under sections 8B, 18B, 29 of the NDPS Act, pending in the Court of learned Sessions Judge, Palamau.

Learned counsel for the petitioner submits that false allegation is made against the petitioner of cultivation of poppy plant in the forest area. He further submits that on the date of alleged occurrence the petitioner was working as labour in Chaurasia Enterprises in the state of Karnataka and to buttress this argument he refers to annexure-2 series which is Form-XIX of the Karnataka Contract Labour (Regulation and Abolition) Rules, 1975 wherein the name of the petitioner is there in Form-XIX. He also submits that co-accused persons have been granted anticipatory bail in A.B.A. No. 3450 of 2025, A.B.A. No. 5705 of 2025 and A.B.A. No. 5730 of 2025. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegation of cultivation of poppy plant is there.

Enterprises with regard to Form-XIX in the light of Rule 78 (1(b) of the Karnataka Contract Labour (Regulation and Abolition) Rules, 1975 wherein the name of the petitioner is there and further co-accused persons have been granted anticipatory bail in the aforesaid A.B.As and even the land is denied of the petitioner.

In the attending facts and circumstance of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge, Palamau, in connection with Panki P.S. Case No. 13 of 2025 arising out of N.D.P.S. Case No. 09 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
