SAILESH REDDY Counsel for the Respondents: GP FOR EDUCATION Counsel for the Respondents: GP FOR REVENUE SRK, J W.P.No.26229 of 2025 3 The Court made the following ORDER: The present Writ Petition has been filed seeking the following relief. “to issue an appropriate writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents in permitting and allowing the construction of a statue within the premises of Alluri Satyanarayana Raju Zilla Parishad High School, Jinnuru Village, Ponduru Mandal, West Godavari District, without obtaining the requisite permissions from the competent authorities as arbitrary, illegal, unjust, contrary to the provisions of the Andhra Pradesh Education Act, 1982, and the Right of Children to Free and Compulsory Education Act, 2009, besides being violative of the petitioners rights guaranteed under Articles 14 and 21A of the Constitution of India, 1950, and consequently direct the respondents to remove the statue/structure from the school premises.” 2. Heard. Perused the record. 3. Case of the petitioner is that he is the son of late Alluri Satyanarayana Raju, a revered freedom fighter, in whose honour the Zilla Parishad High School at Jinnuru village was established in the year 1947 and named as “Alluri Satyanarayana Raju Zilla Parishad High School”. Recently, he came to know that certain persons started constructing a statue within the premises of the SRK, J W.P.No.26229 of 2025 4 said school, purporting to put up a stone inscription that the statue is being installed in the name of one Arimilli Ganga Raju as the alleged “donor of the land” and the said activity is being undertaken under the banner of “2004-2005 Old Students’ Association” without any permission. Hence, he filed the present Writ Petition seeking to direct the respondents to remove the statue/structure from the school premises. 4. Learned counsel for the petitioner submits that the Old Students’ Association has no legal recognition or statutory standing and they are not entitled to undertake such acts in the premises of a Government School and the activity of the said Association is not in accordance with law. 5. On the other hand, learned Assistant Government Pleader for School Education, on written instructions, submitted that without permission from higher authorities and without informing the school in advance, 2004-05 Alumni Students installed the statue of late Arimilli Gangaraju in the school premises during night time of 21.09.2025, when the school was not functioning. In connection with that, as per the instructions of the District Educational Officer, West Godavari, Bhimavaram, a notice was issued to the said Alumni Students on 22.09.2025 requesting them to remove the statue. He further submitted that in similar cases, the Director of School Education, Andhra Pradesh has informed that the request for grant of permission to install statue of late Sri Kolluri Visweshwara Rao, land donor in the premises of Govt. High School, Koyyalagudem, Eluru district, is not feasible for consideration in view of the orders of the Hon’ble Supreme SRK, J W.P.No.26229 of 2025 5 Court of India in SLP (C) No.8519 of 2006, dated 18.01.2013, and GO Ms.No.18, Transport, Roads and Building (Road-1) Department, dated 18.02.2013. The written instructions are placed on record. 6. Learned Assistant Government Pleader produced a copy of letter dated 24.09.2025 addressed by the District School Education Officer, West Godavari, Bhimavaram, to that effect. A perusal of the letter dated 24.09.2025 addressed by the District School Education Officer goes to show that, without obtaining any prior permission from the authorities concerned, the Alumni Students installed the statue of late Arimilli Gangaraju in the school premises during the night of 21.09.2025, and in connection with that, a notice was said to have been issued on 22.09.2025 requesting them to remove the statue. 7. Having regard to the facts and circumstances of the case and the written instructions placed on record, since the Alumni Students installed the statue in the school premises without obtaining any permission from the authorities concerned, the respondents herein are directed to take steps in accordance with law. Till such time, the respondents are directed to ensure that the statue is not unveiled. 8. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
