Respondent No.1-plaintiff had filed a suit for declaration to the effect that he was entitled to Rs.30/- per month as Special Pay according to the instructions of the Secretary, Punjab State Electricity Board, Patiala vide Circular dated 19.06.1973 after merging it in his basic pay. The said suit was filed in the year 1989 and was decreed in the year 1995. An appeal filed by the present appellant against the same was dismissed. 2. On 18.08.1999, at the time when the matter was admitted, the operation of the impugned decree was stayed which stay has continued till date. None had appeared on behalf of respondent No.1 on the last date of hearing and thus, notice was issued to him. Even today no one has appeared on behalf of respondent No.1 to pursue his case. Learned counsel for the appellant has submitted that in view of the above, the present appeal be disposed of at this stage but liberty be granted to the appellant to revive the same in case respondent No.1 approaches the concerned Department to seek implementation of the impugned judgment or files execution application. 4. Keeping in view the abovesaid facts and circumstances, the present Regular Second Appeal is disposed of at this stage with liberty aforesaid. 5. Liberty is also granted to the appellant to revive the present appeal in case any cause survives to the appellant. 6.
